Alabama Parents Hold Primary Consent Rights For child Organ Donation Under State Law

USA: Under Alabama law, parents or legal guardians are the primary decisionmakers when a child passes away and organ donation is considered, guided by the Revised Uniform Anatomical Gift Act. The statute frames how families, hospitals and the state’s only organ procurement organization navigate requests for organ and tissue procurement and subsequent transplantation.

When a child dies in a hospital, staff are required to notify Legacy of Hope, the sole organ procurement center serving Alabama. A specially trained coordinator from Legacy of Hope will contact the family to explain medical options, the procurement process and potential transplantation outcomes, while allowing relatives time and space to decide.

If both parents are present, both should be included in the decision; if one parent has passed away or cannot be located, the surviving parent may provide consent. For divorced parents, legal custody determines who can authorize donation. When neither parent is available, a legal guardian or authorized next of kin may act on the child’s behalf.

Alabama law also limits donor registration by minors: anyone under 18 cannot independently register as a donor without parental or guardian authorization. These provisions aim to balance respect for family authority with timely coordination of organ procurement and transplantation for patients awaiting lifesaving grafts.
