Ohio Legislature Passes Broad Marijuana Rules Amid Alarm Over Organ Transplant Rights

The package draws intense attention because it touches on organ donation and transplantation policy: Columbus Democrat Bill Dimora warned the conference committee report includes language tied to unemployment, housing and organ donation and argued the bill could result in people being denied a life‑saving transplant for marijuana use.

The bill imposes a number of new public‑use and possession limits. Smoking marijuana in public would be banned, open containers would be prohibited inside vehicles and smoking while driving would be barred. Home cultivation would be limited by criminalizing possession of more than 12 plants. Sponsor Steve Huffman, a Republican from Tipp City, said the measure clarifies ambiguous language from the prior ballot initiative, retains the core of Issue 2 and layers in public‑safety and child‑protection regulations.

Packaging and retail rules are also tightened. All cannabis packaging would need to be child‑resistant, and hemp products that contain more than 0.4 milligrams per container would have to be sold through licensed marijuana dispensaries. An explicit carve‑out leaves beverages exempt from that 0.4 mg rule, a pause the legislature attributed to an anticipated federal rule change at the end of next year that it wants to monitor before acting.

The bill’s passage sends the controversy to the governor’s desk, with DeWine publicly favoring restrictions.
